Service Agreement

By scheduling services with NXT Lawn, you agree to the following terms and conditions.

Estimates

All estimates provided by NXT Lawn are baseline approximations based on an initial visual inspection and assumed standard conditions. Final invoicing may be adjusted if:

1. 1Site conditions on the day of service differ from what was visible at the time of the estimate
2. 2Hidden issues are uncovered once work begins, such as buried debris or overgrowth that was not visible during the initial inspection
3. 3You request additions or changes that fall outside the scope of the original estimate

Validity: All estimates are valid for 30 days from the date of issue. Estimates not accepted within that window may be subject to re-evaluation.

Variance: Estimates reflect anticipated time based on conditions at the time of assessment, and are subject to an automatic 15% variance to account for minor, unforeseen field variables without requiring a work stoppage.

Additional Labor: If conditions require time beyond the 15% buffer, work will pause and the adjustment will be communicated to the client for approval before the job is completed. Any approved additional labor will be billed at the applicable hourly rate.

Hidden Hazards & Liability

NXT Lawn exercises reasonable care while servicing your property. However, we are not liable for damage to unmarked or hidden objects, including but not limited to: irrigation heads, shallow cables/wires, invisible dog fences, or toys left in the grass. Please flag any hidden hazards prior to your first service.

Payment & Late Payment Pause

We accept Cash, Check, Credit Card, Debit Card, Venmo, and Zelle. Card payments are processed securely through Stripe. Invoices are generally sent via email following service, but they can also be handed or mailed.

Due Date: Payment is due upon receipt of the invoice.

Checks: Please make checks payable to NXT Lawn LLC.

Late Payments: To keep our rates competitive, we cannot carry balances. Service will be automatically paused for any accounts with an outstanding balance over 7 days. Service will resume once the balance is paid in full.

Scheduling & Cancellations

Service days are scheduled based on route efficiency. While we aim for consistency, service days are subject to change due to weather or ground conditions.

Rain Delays: If we are unable to mow due to rain, we will service your property on the next viable day.

Cancellations: Please provide at least 24 hours' notice if you need to skip a service. Cancellations made on the day of service (or if we arrive and cannot access the yard) will incur a trip charge of $10.

Property Conditions

To ensure quality service and protect our equipment, we ask that properties be reasonably clear of personal property and pet waste prior to scheduled service.

Pet Waste Policy: If an unreasonable amount of pet waste is present on the property at the time of service and comes into contact with our equipment, a $20 cleaning fee will be added to your invoice. We recommend clearing your yard of pet waste before your scheduled service day.

Fuel Surcharge Policy

To maintain competitive pricing on our standard services, NXT Lawn reserves the right to apply a temporary fuel surcharge if local fuel prices rise significantly.

Status: We are not currently applying this, we simply reserve the right to impose it.

Trigger: If the average price of regular unleaded gasoline in the Mound, MN area exceeds $4.00 per gallon, a surcharge of 3% may be applied to each visit.

Notification: You will be notified via email or invoice note before any surcharge is applied. We pledge to remove this surcharge immediately once local fuel prices drop below the trigger threshold.

Scope of Work & Debris Limitations

NXT Lawn operations are strictly limited to turf maintenance, cleanups, and organic yard waste removal. Our transport equipment is optimized for high-volume, low-weight material.

Approved Debris: Hauling services are limited to organic yard waste generated during routine maintenance — grass clippings, leaves, weeds, and light brush.

Restricted Materials: We do not provide junk removal services. NXT Lawn will not haul dense, structural, or hazardous materials, including but not limited to: treated landscaping timber, concrete, rocks, dirt, construction materials, or household trash.

Contamination Policy: If restricted materials are mixed into organic debris piles, we will haul the organic portion once the restricted materials have been separated by the client.

Change Orders & Out-of-Scope Requests

Definition of Scope: Services are strictly limited to the tasks outlined in the original estimate or active maintenance agreement. Any request for additional work — such as hauling structural debris, clearing unmaintained zones, or adding landscape features — is considered a Change Order.

On-Site Requests: To maintain route efficiency, on-site personnel cannot perform unapproved, out-of-scope tasks. All Change Orders must be formally approved in advance and will be billed separately from standard maintenance invoices.

Pricing & Minimums: Out-of-scope additions are subject to schedule availability. Materials excluded from standard service under our Scope of Work & Debris Limitations may be arranged as a paid Change Order. If accepted, structural debris hauling or specialized labor carries a minimum mobilization fee of $150.

Right of Refusal: NXT Lawn reserves the right to decline any out-of-scope request that falls outside our core service offerings, disrupts daily routing, or exceeds the safe payload capacity of our standard transport equipment.

Media & Marketing Release

Client agrees to allow NXT Lawn to capture photographs or video of the Client's property for business documentation, quality assurance, and marketing purposes (including our website, social media, and printed flyers).

Privacy Commitment: We value your privacy. No personal information, house numbers, or images of people/children will be used in marketing materials without separate, explicit written consent.

Opt-Out: If you prefer that photos of your property not be used for public marketing, please notify us in writing at nick@nxtlawn.com.
